Terms of Service
Draft for legal review — not yet in force. Last updated: [date].
These terms are an agreement between [Company legal name] ("we", "us") and the business that signs up ("you"). By creating an account or using the service you accept them.
1. The service
We provide an assistant that answers your business's phone calls and website chat in English and Spanish: it answers questions from the information you give it, takes bookings and messages, and passes callers to your team when needed. You manage it in our web app.
2. Your account
- You must be at least 18 and authorized to act for the business.
- Keep your sign-in details safe; you're responsible for activity under your account and your team members' accounts.
- The information you give the assistant (hours, prices, policies, answers) must be accurate. The assistant repeats it; it doesn't invent it.
3. Free trial and plans
- New businesses get a free trial of 14 days or 300 minutes of calls, whichever ends first. No card is needed to start.
- When a trial ends without a paid plan, the business moves to the Free plan (website chat only) and phone answering stops.
- Paid plans are billed in advance, monthly or yearly, per location, through our payment provider (Stripe). Prices are listed in the app. Taxes may apply.
- You can cancel any time in the app; the plan runs to the end of the period already paid. We don't refund partial periods except where the law requires.
- We may change prices with at least 30 days' notice by email; the change applies from your next billing period.
4. Phone numbers and calls
- Phone numbers we provide stay ours; we assign them to your business while your plan includes phone answering. We may release a number after your business has been without phone answering for a while.
- You're responsible for how you forward your own phone line to us and for turning forwarding off when you stop.
- Calls may be recorded when the recording setting is on; the assistant tells callers at the start of the call. You agree not to use the service in a way that breaks call-recording, telemarketing or consumer-protection laws.
5. Acceptable use
You won't use the service to: break the law; send spam or unsolicited calls or messages; collect information you're not allowed to collect; give medical, legal or financial advice through the assistant; interfere with the service or try to access other customers' data.
6. Your data and your callers' data
- Your content and your callers' information belong to you. We process it to provide the service, under our Privacy Policy.
- You're responsible for having a lawful basis to share your customers' information with us and for any notice your customers need.
- We may keep de-identified information (with names, phone numbers, emails, addresses and other details removed, and no link to your business) to improve the service, including after your account closes.
7. Closing your account
You can close your business in the app. The assistant stops answering and billing stops right away; your data is erased after 30 days unless you reopen it before then. We keep invoices and payment records as tax law requires, and de-identified information as described above. Each person can delete their own account in Settings › Security.
8. Availability and changes
We work to keep the service running but don't guarantee it will be uninterrupted or error-free; phone networks and speech recognition can fail or mishear. Don't rely on the assistant for emergencies. We may change or improve the service; we'll tell you in advance about changes that reduce what your plan includes.
9. Liability
To the extent the law allows: the service is provided "as is"; we're not liable for indirect or consequential losses (such as lost bookings or profits); and our total liability is limited to what you paid us in the 12 months before the claim.
10. Ending these terms
You can stop using the service any time. We may suspend or end your account if you break these terms or don't pay, with notice where reasonable.
11. General
These terms are governed by the laws of the State of [Florida], USA. Disputes go to the courts of [county], [Florida]. If part of these terms is unenforceable, the rest still applies.
